Consider putting an extended disclaimer in your book that comes after the copyright jargon to protect your opinions, advice,and information.In other words, tell readers that they are reading your book and applying your advice at their own risk. The thing to be aware of that most authors donââ¬â¢t realize is that these donââ¬â¢t have to be boring. On the contrary, the more personality these have, the more likely theyââ¬â¢ll be read. A disclaimer is meant to protect you, but it canââ¬â¢t hurt if your audience actually reads it.Helen Sedwick did a great job collecting examples of authors who got creative with their disclaimers and made their work all the better for it. Letââ¬â¢s take a look at some specific examples of different types of disclaimers for different types of books.#1 Fiction Copyright DisclaimerThe typical disclaimer youââ¬â¢ll find in works of fiction?The characters in this book are entirely fictional. Any resemblance to actual persons living or dead is entirely coincidental.How could this be ââ¬Å"livenedâ⬠up? See how Thomas Wolf in A Man in Full, acknowledges that parts of his story are from real life:This novelââ¬â¢s story and characters are fictitious. Certain long-standing institutions, agencies, a nd public offices are mentioned, but the characters involved are wholly imaginary.Or Margaret Atwood in Catââ¬â¢s Eye tries to dispel readersââ¬â¢ assumption that the book is the alter-ego of the writer:This is a work of fiction. Although its form is that of an autobiography, it is not one. Space and time have been rearranged to suit the convenience of the book, and with the exception of public figures, any resemblance to persons living or dead is coincidental. The opinions expressed are those of the characters and should not be confused with the authorââ¬â¢s.If youââ¬â¢ve written about a prominent figure that people might be familiar with and donââ¬â¢t want confusion over whether youââ¬â¢re now writing history or still sticking with fiction, you can approach it similar to D. M. Thomas dealt with using Freud as a character in The White Hotel:The role played by Freud in this narrative is entirely fictional. My imagined Freud does, however, abide by the generally kno wn facts of the real Freudââ¬â¢s life, and I have sometimes quoted from his works and letters, passim. This work is sold with the understanding that neither the author nor the publisher are held responsible for the results accrued from the advice in this book.However, Rebecca Sklootââ¬â¢s The Immortal Life of Henrietta Lacks found a way to get her disclaimer to speak to the honesty of the text:This is a work of nonfiction. No names have been changed, no characters invented, no events fabricated.A nonfiction book copyright page looks like this:#3 Memoir Copyright DisclaimerThe typical disclaimer youââ¬â¢ll find in memoirs ?This book is memoir. It reflects the authorââ¬â¢s present recollections of experiences over time. Some names and characteristics have been changed, some events have been compressed, and some dialogue has been recreated.But in The Boyââ¬â¢s Life by Tobias Wolf, he buries his disclaimer in his acknowledgments. As he thanks those who read drafts of the book, he says:I have been corrected on some points, mostly of chronology. Also my mother claims that a dog I describe as ugly was actually quite handsome. Iââ¬â¢ve allowed some of these points to stand, because this is a book of memory, and memory has its own story to tell. For example, the works of Shakespeare and Beethoven, and most early silent films are in the public domain either by virtue of their having been created before copyright existed, or by their copyright term having expired. Some works are not covered by copyright, and are therefore in the public domain- among them the formulae of Newtonian physics, cooking recipes, and all computer software created prior to 1974. Other works are actively dedicated by their authors to the public domain; some examples include reference implementations of cryptographic algorithms, the image-processing software ImageJ, created by the National Institutes of Health, and the CIAââ¬â¢s World Factbook. The term public domain is not normally applied to situations where the creator of a work retains residual rights, in which case use of the work is referred to as ââ¬Å"under licenseâ⬠or ââ¬Å"with permissionâ⬠.Plagiarism: is the ââ¬Å"wrongful appropriationâ⬠and ââ¬Å"stealing and publicationâ⬠of another authorââ¬â¢s ââ¬Å"language, thoughts, ideas, or expressionsâ⬠and the representation of them as oneââ¬â¢s own original work.First Amendment (Amendment I): to the United States Constitution prevents Congress from making any law respecting an establishment of religion, prohibiting the free exercise of religion, or abridging the freedom of speech, the freedom of the press, the right to peaceably assemble, or to petition for a governmental redress of g rievances. It was adopted on December 15, 1791, as one of the ten amendments that constitute the Bill of Rights.Fair use: in its most general sense, a fair use is any copying of copyrighted material done for a limited and ââ¬Å"transformativeâ⬠purpose, such as to comment upon, criticize, or parody a copyrighted work. Such uses can be done without permission from the copyright owner. In other words, fair use is a defense against a claim of copyright infringement. If your use qualifies as a fair use, then it would not be considered an infringement.Libelous writing: can be personal libel or trade libel, which is also known as ââ¬Å"product disparagement.â⬠Product disparagement can include a product, service or entire company. Libelous statements, whether against persons or products, are published statements that are false and damaging. Slander is the same as libel in most states, but in spoken rather than written form. A legal concept that allows the reproduction of copyrighted material for certain purposes without obtaining permission and without paying a fee or royalty. Purposes permitting the application of fair use generally include review, news rep orting, teaching, or scholarly research. If you use something published by someone else with the sole purpose of monetary gain, this doesnââ¬â¢t constitute fair use.#3 Can I write about real people?Especially in works of nonfiction, real people are often mentioned to express an opinion or as an example to clarify the writerââ¬â¢s fact or opinion. Generally, you can use the names of real people as long as the material isnââ¬â¢t damaging to their reputation or libelous. Stick to the facts and write about what is true based on your research.#4 Can I borrow lyrics from songs?Stephen King often used song lyrics for his books including Christine and The Stand. He obtained permission for these works. King says, ââ¬Å"Lyrics quotes in this book [Christine] are assigned to the singer most commonly associated with them. This may offend the purist who feels that a song lyric belongs more to the writer than the singer.â⬠Basically, song lyrics fall under strict copyright even if it is just a single line used. Try to get permission if you use a song. You can contact the American Society of Composers, Authors and Publishers (ASCAP) or Broadcast Music, Inc. (BMI). Once you find the rights owner, you have to ask for permission through writing.#5 Do I need permission to borrow material from a book that is over 100-years-old?Once the copyright on a book or material has expired, or the author has been dead for seventy years, the work enters into the public domain and you can use it without permission or licensing. BUT this does vary from country to country. You can check the copyright office in the US here.#6 Are authors liable for content used in a book?Yup.Even with traditional publishing houses, the author is still responsible for the content written and used in the book.In fact, traditionally published authors usually have to sign a waiver that removes the publisher from any liability pertaining to the material the author used if the writer included that ma terial without proper permission. And you already know, as a self-published author, youââ¬â¢re on your own.#7 If I use an inspirational quote from another writer or famous person, do I need permission?You donââ¬â¢t need permission to use quotes in a book provided that you credit the person who created it and/or spoke the quote.For example: ââ¬Å"Is all that we see or seem but a dream within a dreamâ⬠ââ¬âEdgar Allan Poe#8 What is the best way to protect my work from being stolen?Your work is copyrighted as soon as it is written.But you can register your work with the US copyright office. If you have a blog where you also post content, you need to have a Terms Privacy disclaimer on your page. This would preferably be at the top where it is easy to see, although many writers and bloggers include this at the bottom of every page.You should also include your Copyright on your blog that protects your content from being ââ¬Å"copied and pastedâ⬠into another site without permission or recognition.#9 A royalty free stock photo means that I can use it for free and donââ¬â¢t have to get permission, right?Wrong.Most stock photos are copyrighted, even if they appear in search engines and we can easily download or copy them. If you grab a photo off the net and think you can slap it on a book cover or use it for free in your book, think again. The Houston school system managed to reduce expenditure while the school systems that showed an increase in expenditure were criticized for it. This situation is quite similar to the one experienced by other school systems around the country as discussed by Williams (2008) and Romanek (2008). Essentially, school budgets need to show that the schools are spending money in the right direction but it can be difficult to do so in times where rising costs are a fact of life. Romanek (2008) discusses how some schools are facing pressure on their budgets from rising fuel costs and need to move towards alternative fuels in order to make sure that they can meet the needs of the students while remaining within the funds that have been budgeted for their expenditure. While school busses run on diesel instead of gasoline, the prices for diesel itself have risen by almost three hundred percent in the last five years. While schools in the country are being forced to maintain their spending within the same budgetary constraints, schools systems are dealing with increased prices which automatically create a reduction in services. Schools may have to run fewer routes, eliminate positions for technology related teachers or even have to reduce the extra programs which they may offer to their students. Conflict Between Therapeutic and Forensic Roles of Psychologists Essay
Abstract The Ethical Principles and Code of Conduct, published by the American Psychological Association are the standard guidelines for all Psychologists. Forensic Psychologists are also informed by Specialty Guidelines for Forensic Psychologist. Psychologists practicing forensic psychology can use these two documents to help clarify ethical questions. This paper will focus on role conflicts specifically in the area of Sex Offender Management and the ethical conflicts that may arise as a result and how to best handle this situation when faced with it. When an individual chooses to practice psychology within the legal system, they must be aware that this can at any point in their career lead to ethical conflicts. Just the possibility alone of ethical dilemmas, are or should be a concern for forensic psychologists. -------------------------------- In reading the article: Expert Opinion Revisiting the ââ¬Å"Irreconcilable conflict between Therapeutic and Forensic Roles Implications for sex offender specialistsâ⬠Christmas Covell, Ph.D & Jennifer Wheeler, Ph.D; I found that I was in complete agreement with the authors. I believe that it is extremely important for a forensic psychologist or forensic psychiatrist to determine their role in the beginning. When the professional determines and agrees to their role upfront, life in this filed may possibly be a little easier. It is never in my opinion a good idea to conduct both therapy and assessments on the same person. Especially when working with the sex offender population. When you attempt to have a dual role in providing both therapy and assessment more harm is done than good. According to Greenburg and Schuman (1997) â⬠dual roles have the potential to intentionally or ... ...rensic and the therapeutic evaluators to ask themselves ââ¬Å"Do I (or will I foreseeably) have another role with the individual being evaluated that might impair my clinical judgement and/or therapeutic alliance? Do I (or will I forseealby) have another role with the individual being evaluated, which might impair my objectivity and/or my credibilityâ⬠? At the end of the day the most important fact to remember is that both parties share a common goal. That goal is to prevent sex offenders from reoffending and prevent most importantly in my opinion future victims. Horse Jumping
Horse jumping Many people may say that itââ¬â¢s a dangerous sport and that you have to be crazy for doing it but, after they try it once they wonââ¬â¢t leave it. Risking your life is worth it when you find passion on and over the horse, finding lots of new, rich and encouraging experiences that will make you grow as a person and as a rider; as, when you jump, you need to be focused, you even forget about problems you may have, it helps you not being a rancorous person. When you jump once you want to jump twice, the sensation is amazing, and after a while it becomes addictive; thatââ¬â¢s something Iââ¬â¢ve learned from this wonderful activity. Horse jumping doesnââ¬â¢t have an exact date of beginning, but we can say that after the second half of the XVIII century this sport was practiced during the hunting activity. Since then the horseââ¬â¢s breeds have been taken care of, within the proper horse training; all of this to get a better speed and physic ability for jumping and getting the actual bases for modern horse jumping; nowadays there are two types of horse jumping contests, one that is based on jumping a single obstacle starting in 1. 0 meters high, and the other one that is based on jumping several obstacles (mostly ten) starting in 0. 70 meters, over to 1. 70 meters. You can learn how to recover from a fall (physically and metaphorically), even though itââ¬â¢s pretty hard; because for being successful in any activity you need to learn how to step up and continue with the same courage you started, I can say that with horse jumping I have proved to myself that the phrase ââ¬Å"what doesnââ¬â¢t kill you m akes you strongerâ⬠is absolutely right, after falling down you need to go over the same obstacle with more concentration and strength. Thatââ¬â¢s how many world champions have gotten were they got, as Rodrigo Pessoa from Brazil, who was claimed champion in 1998 with his horse Gandini Lianos, or as Jos Lansink, who was claimed champion in 2006 with his horse Cavalor; they are a couple of the latest world champions in a contest that is done every 4 years and is organized by the FEI (International Equestrian Federation). The contests are ualified based on penalties, which you get when your horse refuse to an obstacle, when you confuse the sequence, when you fall down, or when you jump over the obstacle but one of the wood sticks falls down; each of this penalties is worth 4 points, when you get 12 points in penalties you are disqualified from the contest; if there is a tie (which normally happens), the time that each of the riders lasted is taken care of and the one with shortest time wins. Horse jumping shows you how to get rid of any kind of heart feelings, I have learned that after been betrayed by anyone you need to forgive them and try it again, been more careful, but trusting on them after all, when your horse refuses to jump you need to try it again been more focused and having all the control on your hands. Thatââ¬â¢s how Alberto Larraguibel broke the horse jumping record in Vina del Mar with his horse Huaso jumping an obstacle of 2. 47 meters high; there had been higher records, but none of them have been in an official competition; the FEI has established that the next worldââ¬â¢s record should be over the 2. 49 meters high. I used to do horse jumping about half a year ago, I used to do it for a long time, and this activity has proved me that Iââ¬â¢m able to do things that I wouldnââ¬â¢t have imagined I could; it has helped me to get rid of some fears that I had, and basically to risk myself for discovering lots of new things and sensations that the world can offer me. For doing horse jumping you need to have the horse riding pants, a security helmet, a short whip, horseback riding boots, riding gloves, and for preparing the horse you will need a bridal halter, the horse seat equipment and the horse seat, as an external equipment you will need the obstacle. The sensation of being on the air over such a big animal, after a while becomes addictive; when you jump all the adrenaline or fear from the preparing is vanished, and after doing it for the first time not only the preparation fear is gone and the post jumping satisfaction is amazing, you feel capable of doing more, and within that, lots of your life fears are gone; in my experience before doing this I was scared from horses, but I ended up loving them, loving the sensation, and been more open minded in oing other kind of riskful activities that can offer you invaluable sensations; I think horses are beautiful animals, and besides their enchantment I am completely amazed about the fact of controlling such a big animal to even make them jump. Iââ¬â¢ve learned to love nature and all the wonderful things you can find on it, this is the principal reason why this is my passion.
